Debt Collection in Switzerland (Betreibung): Process and Your Rights

What happens after an unpaid bill, how to object and how to avoid a record in the register.

6 min read ยท Loans & Credit

Ignoring unpaid bills can lead to formal debt collection. Understanding the steps helps you act in time.

The steps

  1. Invoice, reminder and final reminder from the creditor.
  2. The creditor files a request for debt enforcement (Betreibungsbegehren) at the local office.
  3. You receive a payment order (Zahlungsbefehl).
  4. You have 10 days to file an objection (Rechtsvorschlag) if you dispute the claim.
  5. If you do not object or the court removes your objection, the creditor can ask for seizure of wages or assets, or bankruptcy.

If you owe the money

Pay or agree a payment plan with the creditor before things escalate. Interest of 5 % and collection costs can add up. If you cannot pay, free debt counselling is available in each canton.

If you dispute the claim

Objecting is simple and does not require reasons, but the creditor may then go to court. Objecting to an unfounded claim stops enforcement for now.

The register extract

Enforcement entries appear on your extract from the debt enforcement register for years and may harm rental applications and credit. Paid claims can be removed on request in some cases when the creditor agrees or after a certain time.
